In law, to distinguish a case means to contrast the facts of the case before the court from the facts of a case of precedent where there is an apparent similarity. By successfully distinguishing a case, the holding or legal reasoning of the earlier case will either not apply or will be limited. Whether a case is successfully distinguished often looks to whether the distinguished facts are material to the matter. Both cases Balfour v. Balfour (1919) and Merritt v Merritt (1971), involve a wife making a claim against her husband for breach of contract. The judge in Balfour decided that a claim could not be made because there was no intention to create legal regulations, there was no legally binding contract. However in Merritt v. Merritt, the judge decided that the facts of this case was sufficiently different in that, while the parties were husband and wife, the agreement was made after they had separated, in writing, thus distinguishing the case from Balfour. It's a matter of binding precedent. The higher the judge, the higher the court that judge will be sitting in and the more binding his decisions on inferior courts. The decisions of a district court, county court or crown court judge will perhaps be of persuasive value to other courts, but they will not be binding upon them. Once a case reaches the Divisional Court, the Court of Appeal lower courts will be bound by the decision. If it gets to the House of Lords, the decision must be followed by the lower courts and if another decision of the House of Lords departs from it, it must be because it is possible to distinguish it from that decision in some material way. In twin studies, if one twin develops type 1 diabetes there is a 50% probability that the other twin will develop type 1 diabetes. The specific genetic markers have been identified, but it is not know if you have such genes, what the probability of subsequent diabetes is. For type 2 diabetes the genetic link is stronger, but the genes have not been identified, and it is presumed to be poly-genetic.
